Privacy policy

We protect your privacy. The legally compliant collection, processing and use of your personal data is very important to us and is carried out in accordance with the provisions of the Federal Act on Data Protection (FADP), Ordinance to the Federal Act on Data Protection (OFADP), Law on Telecommunications (LTC), Federal Act against unfair competition (UCA) and insofar as applicable the General Data Protection Regulation of the European Union (GDPR). This Privacy Policy below informs you of the nature, scope and purpose of the processing of your personal data when you visit our website.

Personal data

Personal data is any information that relates to an identified or identifiable natural or legal person. Identifiable is a person who can be identified directly or indirectly, in particular by association with an identifier such as a name, with an identification number, with location data, with an online identifier or with one or more special features, the expression of the physical, physiological, genetic, mental, economic, cultural or social identity of this natural person.

The storage of your personal data will only be carried out in cases where this is necessary to provide the booked service, to comply with legal requirements or for any of the following purposes.

Collection, processing and use of personal data

In principle, we process your personal data only insofar as this is necessary for the provision of a functional website and our content and services. The processing of your personal data is carried out only after your consent. An exception applies to cases in which prior consent cannot be obtained for factual reasons and when the processing of the data is permitted by law.

We use the personal data stored by us also for the care of the customer relations, for the care of our customers (e.g. important information for your journey), for the implementation of own advertising and marketing measures (e.g. the dispatch of catalogs other advertising broadcasts within the legally permissible framework, inquiries to customer satisfaction) and order processing.

When processing your personal data in the context of the application process, your application documents will be reviewed by the staff of our human resources department upon receipt and forwarded internally to the responsible department heads. As part of the application process, only employees who are necessary for the proper process have access to your data.

Transfer of data to third parties

No personal data will be disclosed and transferred to any third parties for purposes other than those listed below.

We only disclose your personal information to third parties if:

  • a transfer is legally permissible and necessary for the execution of the contractual relationship with you,
  • there is a legal obligation to disclose
  • disclosure is required to assert, exercise or defend legal claims and there is no reason to believe that you have an overriding legitimate interest in not disclosing your information, or
  • you have given us your express consent to this disclosure.

If a service has been provided via the website (e-hoi integrated booking engine) of a Swiss tourism organization cooperating with e-hoi, e-hoi may pass on data from customers in Switzerland to this tourism organization so that in turn it can provide information relating to the processing of the requested service.

The transfer of personal data can also be made to third parties (commissioned service providers) abroad. However, this occurs only if the above-mentioned points are met and the commissioned service provider complies with the data protection regulations of Switzerland or the EU. If the local data protection regulations of the country do not meet the standards of Switzerland or the EU, the protection of personal data is additionally guaranteed by contract.

Data erasure and storage duration

The personal data of the data subject will be deleted or blocked in accordance with the law as soon as the purpose of the storage is omitted. In addition, such storage may be provided for by the national or European legislature in regulations, laws or other regulations to which the controller is subject. Blocking or deletion of the data also takes place when a storage period prescribed by the standards mentioned expires, unless there is a need for further storage of the data for conclusion of a contract or fulfillment of the contract.

Due to the regulations of Swiss accounting as well as tax regulations, any business communication, accounting documents as well as contracts must be stored for up to 10 years.

Newsletter

In the following, we would like to inform you about the content of our newsletter as well as the registration and transit procedure as well as your right of objection.

If you have registered for the e-hoi newsletter, we will use your data for the purpose of sending the e-hoi newsletter. We send newsletters with promotional information only with the consent of the recipient or a legal permission. Our newsletters contain information about our products, offers, promotions, events and our company. The UWG serves as the legal basis for sending the newsletter and advertising by email as a result of the sale of goods or services.

The registration for our newsletter takes place in the so-called double opt-in procedure. In other words, after registration, you will receive an e-mail requesting confirmation of your subscription to the newsletter. This confirmation ensures that nobody can log in with external e-mail addresses. The registrations for our newsletter are logged in order to prove the registration process according to the legal requirements. This includes the storage of the registration and confirmation time as well as your IP address. If there is a legitimate interest in the business, we can send newsletters without double-opt-in procedures to clients living in Switzerland (Art. 3 (1) lit. o UCA).

To subscribe to our newsletter, it is sufficient to enter your e-mail address. Optionally, we ask for a name, for the purpose of personal address in the newsletter. The newsletters contain a so-called "web-beacon", i.e. a pixel-sized file, which is retrieved from the server of the shipping service provider when the newsletter is opened. This call will initially collect technical information, such as information about the browser and your system, as well as your IP address and time of retrieval. This information is used to improve the technical performance of the services based on the technical data or target groups of your reading habits based on their call locations (which can be determined using the IP address) or access times. The statistical surveys also include determining whether the newsletters are opened, and which links are clicked. Although this information can be assigned to individual newsletter recipients for technical reasons, it is neither our endeavor nor that of the shipping service provider to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Furthermore, we want to ensure that the information regarding our products, offers, promotions, events and our company is tailored to your personal interests. As such, we use the personal information you provide to find out about which products, offers, etc. you are particularly interested in. This helps us customise our messages and make them more relevant to you. We take existing information, e.g. email confirmations and read receipts, your previous order history, date and time of visiting our website, products that you have looked at. This process is exclusively carried out in encrypted format. These analyses help us to better understand you as a customer and allow us to provide you with personalised offers that better suit your needs. If you do not wish to receive this personalised service, you can opt out of personalised advertising at any time by sending us an email to . In this case, you will continue to receive our regular newsletter only.

The dispatch of the newsletter and the success measurement are made based on a consent of the recipients acc. DSG, VDSG, UWG and where applicable DSGVO. The logging of the registration process takes place based on our legitimate interests and serves the proof of the consent to the receipt of the newsletter. You can terminate the receipt of our newsletter at any time, i.e. revoke your consent. You can find a link to cancel the newsletter at the end of each newsletter or alternatively you can request your opt-out at any time at .

Cookies

We set temporary and permanent cookies, i.e. small files that are stored on the users' devices. Cookies are information transmitted from our web server or from a third-party web server to the users' web browsers and stored there for later retrieval. Cookies can be small files or other types of information storage. By saving the data you requested on your computer, the use of our website is made easier for you. When the website is called up again, the stored data is displayed again. The user data is not stored on the servers of e-hoi at any time. In part, the cookies are used for security or to operate our online offer (for example, to display the website) or to save the user's decision when confirming the cookie banner. In addition, we or our technology partners use cookies for measuring range and marketing purposes, which users are informed about in the course of the privacy policy.

We use "session cookies" that are only stored for the duration of the current visit to our online presence (for example, to enable the storage of your login status or the shopping cart function and thus the use of our online offer at all). In a session cookie, a randomly generated unique identification number is stored, a so-called session ID. In addition, a cookie contains information about its origin and storage period. Storage of the IP address

An IP address is a unique number that your Internet service provider assigns to your computer when you connect to the Internet. When visiting our website, the IP address assigned to your computer is stored permanently by our web server. This IP address can be used by us as part of statistical evaluations and is deleted and archived at regular intervals (every six months) by our servers. Your personal data, however, always flows anonymously into these evaluations. Your IP address will only be disclosed to third parties, if required so by law, or the data is processed by third parties as ordered.

Google Analytics

We use Google Analytics, a web analytics service of Google LLC ("Google"), based on our legitimate interests (that is, interest in analyzing, optimizing, and operating our online offering). Google uses cookies. The information generated by the cookie about the use of the online offer by the users are usually transmitted to a Google server in the USA and stored there. Google is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate the use of our online offer by users, to compile reports on the activities within this online offer and to provide us with further services related to the use of this online offer and the internet usage. In this case, pseudonymous usage profiles of the users can be created from the processed data.

We use Google Analytics to display advertisements displayed within Google and its affiliate advertising services, only to those users who have shown an interest in our online offering or who have certain characteristics (e.g. interests in specific topics or products visited by them on Web pages) that we submit to Google (so-called "remarketing" or "Google Analytics audiences"). With remarketing audiences, we also want to make sure that our ads are in line with the potential interest of users and are not annoying.

We only use Google Analytics with activated IP anonymization. This means that the IP address of the users will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there.

The IP address submitted by the user's browser will not be merged with other data provided by Google. Users can prevent the storage of cookies by setting their browser software accordingly; users may also prevent the collection by Google of the data generated by the cookie and related to their use of the online offer and the processing of such data by Google by downloading and installing the browser plug-in available under the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

Google-Re/Marketing-Services

We use the Marketing and Remarketing Services ("Google Marketing Services") of Google LLC, 1600 Amphitheater Parkway, Mountain View, CA, based on our legitimate interests (ie, interest in analyzing, optimizing, and operating our online services) 94043, USA, ("Google").

Google is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google Marketing Services allow us to more clearly display advertisements for and on our website so as to present to users only ads that are potentially reflect their interests. If a user e.g. is shown ads for products, he/she has been interested in on other websites, it is called remarketing. For these purposes, when Google and our other websites accessing Google Marketing Services are directly accessed by Google, a code will be executed by Google and so-called (re) marketing tags (invisible graphics or code, also called "Web Beacons ") incorporated into the website. With their help, the user is provided with an individual cookie, i.e. a small file is saved (instead of cookies, comparable technologies can also be used). The cookies can be set by different domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. In this file it is noted which web pages the user visited, for what content he is interested in and what offers he has clicked, as well as technical information about the browser and operating system, referring web pages, time of visit and other information regarding the use of the online offer. The IP address of the users is also recorded, whereby in the context of Google Analytics we announce that the IP address is shortened within member states of the European Union or other parties to the Agreement on the European Economic Area and only in exceptional cases to one Google server in the US is transmitted and shortened there. The IP address will not be merged with data of the user within other offers from Google. The information above may also be linked by Google with such information from other sources. If the user then visits other websites, they can be displayed according to the user' interests, the ads tailored to the user.

The data of the users are processed anonymously in the context of the Google marketing services. In other words, Google does not store and process the name or e-mail address of the users but processes the relevant data cookie-related within anonymous user profiles. In other words, from the perspective of Google, the ads are not managed and displayed for a specifically identified person, but for the cookie owner, regardless of who that cookie owner is. This does not apply if a user has explicitly allowed Google to process the data without this pseudonymization. The information collected about users through Google Marketing Services is transmitted to Google and stored on Google's servers in the United States.

Among the Google marketing services we use is inter alia the online advertising program "Google AdWords". In the case of Google AdWords, each advertiser receives a different "conversion cookie". Cookies cannot be tracked through the websites of advertisers. The information collected through the cookie is used to generate conversion statistics for AdWords advertisers who have opted for conversion tracking. Advertisers will see the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, they do not receive information that personally identifies users.

We can engage third-party ads based on Google's DoubleClick marketing service. DoubleClick uses cookies that enable Google and its affiliate websites to serve ads based on users' visits to this site or other websites on the Internet.

We can incorporate third-party ads based on the Google AdSense marketing service. AdSense uses cookies that enable Google and its affiliate websites to serve ads based on users' visits to this website or other websites on the Internet.

Also, we can use the service "Google Optimize". Google Optimize allows us to understand how various changes to a website (such as changes in the input fields, the design, etc.) can take place in what is known as "A/B testing." Cookies are stored on users' devices for these purposes. Only pseudonymous data of the users are processed.

In addition, we may use the "Google Tag Manager" to integrate and manage the Google Analytics and Marketing Services on our website.

Criteo

Based on our legitimate interests (i.e., interest in the analysis, optimization and economical operation of our online offer), we use the services of the provider Criteo GmbH, Gewürzmühlstr. 11, 80538 Munich, Germany.

The services of Criteo allow us to display ads for and on our website more targeted, to present only those ads to the users that potentially meet their interests. If e.g. ads are shown to users showing products they have been interested in on other websites, it is called remarketing. For these purposes, when our and other websites where Criteo is active are retrieved, Criteo immediately executes a Criteo code and so-called (re) marketing tags (invisible graphics or code, also known as web beacons "designated"). With their help, users are provided with an individual cookie, i.e. a small file is saved (instead of cookies, comparable technologies can also be used). In this file it is noted which web pages the users visited, what content they are interested in and what offers they have clicked, as well as technical information about the browser and operating system, referring to web pages, time of visit and other information on the use of the online offer. The information above may also be shared by Criteo with information from other sources. If the user then visits other websites, the ads can be displayed in accordance with the users interests. e-hoi customer account and Cruise Club

To provide you with personalised customer service and convenience, we process the personal data you voluntarily provide in your customer account in accordance with Art. 6 (1) f GDPR. The legal basis for the processing of your data is your voluntary consent in accordance with Art. 6 para. 1 a) GDPR.

Both the customer account and participation in the Cruise Club are free of charge. For easy and convenient use of the customer account and Cruise Club, we offer the option to permanently store your personal data (title, name, address and e-mail address) and the option of saving it in a password-protected area. Please note that participation in the customer account and Cruise Club requires the entry and storage of these information. Participation in the Cruise Club takes place automatically with the creation of a customer account.

It is possible to cancel your participation in the Cruise Club and continue to use the functions of the customer account. However, if you cancel your participation in the Cruise Club, any Cruise Coins you have collected up to that point and the status level you have achieved will be lost. Facebook Social Plugins

Based on our legitimate interests (i.e. interest in analyzing, optimizing and operating our online offer), we use social plugins ("plugins") from the social network facebook.com, which is operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbor, Dublin 2, Ireland ("Facebook"). The plugins can represent interaction elements or content (e.g. videos, graphics or text contributions) and can be recognized by one of the Facebook logos (white "f" on blue tile, the terms "Like," "Like" or a "thumbs up" sign) or are marked with the addition "Facebook Social Plugin." Facebook is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

When a user invokes a feature of this online offering that includes such a plugin, their device establishes a direct connection to the Facebook servers. The content of the plugin is transmitted by Facebook directly to the device of the user and incorporated by the user into the online offer. In the process, user profiles can be created from the processed data. We, therefore, have no influence on the amount of data that Facebook collects with the help of this plugin and, therefore, we inform the users according to our knowledge.

By integrating the plugins, Facebook receives the information that a user has accessed the corresponding page of the online offer. If the user is logged in to Facebook, Facebook can assign the visit to his Facebook account. If users interact with the plugins, for example, press the Like button or leave a comment, the information is transmitted from your device directly to Facebook and stored there. If a user is not a member of Facebook, there is still the possibility that Facebook will find out and save their IP address. According to Facebook, only an anonymous IP address is stored in Germany.

If a user is a Facebook member and does not want Facebook to collect data about him/her via this online offer and link it to his/her member data stored on Facebook, the user must log out of Facebook and delete their cookies before using our online offer. Facebook Connect

We offer you the possibility to sign in or register for our e-hoi customer account by using your Facebook access (so-called Facebook-Connect function). Facebook-Connect is a service of the social network Facebook, which is operated by Facebook Inc. (1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). An additional registration for the e-hoi customer account is then no longer necessary. For the sign-in you will be forwarded to the website of Facebook, where you can sign-in with your usage data. Your Facebook profile and the service of e-hoi are hereby linked with one another. Through the link that information is automatically transmitted to us by Facebook, for which you have granted your consent to their transmission (first name, last name, profile photo, email-address). We use this information in order to be able to identify you within the scope of the use of our e-hoi customer account.

We use these services of the data processing pursuant to the legal basis of Art. 6 Para. 1 a) GDPR.

Google Sign In

We offer you the possibility to sign-in or register for our e-hoi customer account by using the access data of your Google account. If you use your Google login, Google also processes your data. We are not responsible for this data processing. With the Google login, after your release, we receive the following data from Google: first name, last name, profile photo, email-address. We only receive this information insofar as they belong to your public profile in accordance with your personal settings and once at the time of the registration. The aforementioned data released by you will be taken over into your e-hoi customer account.

Google Plus

Our online offer includes features of the Google+ service. These features are offered through third party provider Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA. If you're logged in to your Google+ account, you can link to our Google+ page by clicking the Google+ button. This allows Google to associate with your user account. Mouse flow

Within our online offering, we use Mouseflow, a web analysis tool of Mouseflow ApS, Flaesketorvet 68, 1711 Copenhagen, Denmark, to collect randomly selected individual visits (only with an anonymous IP address). The result is a log of mouse movements, mouse clicks and keyboard interaction, with the intention to play back and evaluate individual visits to this site at random as so-called session replays in the form of so-called heat maps and derive potential improvements for this website. The data collected by Mouse flow are not personal and will not be disclosed to third parties. The storage and processing of the collected data takes place within the EU. We will send you a review request based on our legitimate interests (i.e. interest in the analysis, optimization and operation of our online service). If you make a travel booking through us, we will send you an e-mail upon your return by giving you the option of writing a review on your travel booking and your review will be published on our website.

Safety measures

We shall take appropriate technical and organizational measures, considering the state of the art, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the different likelihood and severity of the risk to the rights and freedoms of natural and legal persons to ensure a level of protection which is appropriate to the risk. The measures include, in particular, ensuring the confidentiality, integrity and availability of data by controlling physical access to the data, as well as the relevant access, input, transfer, availability and separation. In addition, we have established procedures that ensure the enjoyment of data subject rights, data erasure and data vulnerability. Furthermore, we take take into account the protection of personal data which is already in the development, or the selection of hardware, software and procedures, according to the principle of data protection by technology design and by privacy-friendly default settings into account.

The security measures include, in particular, the encrypted transmission of data between your browser and our server. Thanks to the SSL (Secure Socket Layer) encryption method, your personal data (name, address and telephone number) transmitted via the Internet as well as, if necessary, bank or credit card information, are optimally protected against unauthorized access.

Rights of data subjects

You have the right to ask for confirmation as to whether such data is being processed and for information about that data, as well as for further information and copying of the data.

You have the right to request the completion of the data concerning you or the correction of the incorrect data concerning you.

You have the right to request that the data in question be deleted immediately or alternatively, if the data must be kept for legal reasons, to require a restriction to the processing of the data.

You have the right to request that the data concerning you that you provide us with be obtained and request their transmission to other persons responsible.

If you are a resident of an EU country, you also have the right to file a complaint with the competent supervisory authority pursuant to Art. 77 GDPR.

Right to object

If you are a resident of an EU country, you can object to the future processing of your data in accordance with Art. 21 GDPR at any time. The objection may in particular be made against processing for direct marketing purposes.
